2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 379, 384, 323, 341, 504/34 of the Indian Penal Code.

3. As per prosecution case, the accused persons including the petition are said to have obstructed the informant while he was going by his car. The accused persons snatched key of the car and cash. They also assaulted the informant and fled away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the basis of suspicion. It

No.76400 of 2023(2) dt.01-12-2023 2/2 is also submitted vide para 6 of the petition that the informant had taken his car through finance company Jai Mata Di Repo Agency and the petitioner and co-accused Mantu Kumar are agents of the finance company. The informant was not paying installment of the car due to which they took the car in their possession. The petitioner is employee of finance company due to which he has been made an accused. It is further submitted that the petitioner is languishing in judicial custody since 5.9.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Motihari Muffasil P.S. Case No. 472 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari.
