JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2020 This is an application for grant of anticipatory bail in connection with Kursakanta P. S. Case No. 119 of 2019 disclosing offences under Sections 147, 148, 149, 323, 427, 379, 295, 504 and 506 of IPC.

As per prosecution case petitioners and other named accused persons along with 500 unknown persons came to the shop of the informant, assaulted him and damaged his property. Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against the

Patna High Court CR. MISC. No.72440 of 2019(2) dt.17-01-2020 2/2 petitioners. As a matter of fact, earlier to that a rape was committed by the informant on the daughter of Vijay Kumar, as such, people were engaged and made communal harmony against the informant, for which, the present case has been lodged.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M.-II, Araria, in connection with Kursakanta P. S. Case No. 119 of 2019.
