JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioners seek bail in connection with Saraiya P.S.Case No. 479 of 2018 registered under Sections 272, 273 and 414/34 of the Indian Penal Code and 30(a), 36,38 and 47 of the Bihar Prohibition and Excise Act, 2016 . Allegation is of recovery of 525 litres of illicit foreign liquor from the dickey of the car and it is alleged that petitioners and other persons were travelling in the car. Submission of learned counsel for the petitioners is that petitioners have been falsely implicated in this case having no criminal antecedent and they are in custody for more than two months.

Having heard both sides and in the facts and

No.71885 of 2018(3) dt.20-12-2018 2/2 circumstances, as stated above, let the petitioners, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Saraiya P.S.Case No. 479 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and before releasing the petitioners, their addresses should be verified by the learned court below.
