The petitioner seeks bail in Masaurhi P.S. Case No. 224/2018, instituted for offences under Section(s) 302, 201, 120B and 34 of the Indian Penal Code read with Section 27 of Arms Act.

It is alleged in the written report that on 08.04.2018 brother of informant Mintu Kumar Singh went to the under constructed house of Avinash Kumar on his call, where Avinash Kumar, Divesh Kumar along with this petitioner were present. In the next morning, when the informant did not find his brother he made search and learnt from villagers that there was sound of firing from the house of Avinash Kumar. Informant along with others went there and found blood stain and slippers of his

Patna High Court Cr.Misc. No.77517 of 2018(2) dt.15-01-2019 2/2 brother. The informant raised suspicion against this petitioner and other accused persons.

Learned counsel for the petitioner has submitted that mere suspicion has been raised against this petitioner. The other co-accused, namely, Divesh Kumar has already been granted bail by this Court in Cr. Misc. No. 52618/2018 dated 26.10.2018.

Petitioner is in custody since 10.04.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge VIth, Patna, in connection with Masaurhi P.S. Case No. 224/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
