JUSTICE SANDEEP KUMAR ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 20.08.2022 in connection with Sultanganj P.S. Case No. 287 of 2022 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 385, 386, 387, 504, 506, 307 of the Indian Penal Code and Section 27 of the Arms Act It has been submitted by the learned counsel for the petitioner that the petitioner is agnate of the prosecution side and due to land dispute this F.I.R. has been lodged against the petitioner. He further submits that the petitioner is in custody since 15.08.2022 and similarly situated co-accused have been granted bail by a co-ordinate Bench of this Court, Considering the aforesaid facts, this application for

Patna High Court CR. MISC. No.73667 of 2022(2) dt.04-03-2023 2/2 regular bail is allowed.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail after framing of charge if the charge in not framed yet or on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-I, Bhagalpur in connection with Sultanganj P.S. Case No. 287 of 2022.

The petitioner would cooperate in the proceeding of the Court below. If the petitioner tries to delay the trial, the Court below is at liberty to pass an appropriate order including the cancellation of bail bonds of the petitioner. The petitioner is directed to appear before the Court below through his lawyer or himself on each date, failing which, his bail bonds shall be cancelled.
