JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks regular bail in connection with Thakurganj P.S. Case No. 124 of 2018, registered for offences punishable under Sections 413 and 414 of the Indian Penal Code.

Allegation as per F.I.R. is that police on information recovered a theft motorcycle from the possession of co-accused, who confessed his guilt and disclosed that the stolen motorcycle is in the house of the petitioner and police recovered the same. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and stolen motorcycle has not been recovered from the conscious possession of the petitioner, rather it recovers from the premises of a school, but police has shown that it is recovered from the house of the petitioner. No. 73999 of 2018 and vide order dated 13.12.2018 passed in Cr. Misc. No. 72636 of 2018. The petitioner is in judicial custody since 6.09.2018. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts and also this fact that other co-accused persons have already granted bail, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Thakurganj P.S. Case No. 124 of 2018.
