JUSTICE SANDEEP KUMAR ORAL ORDER 11-12-2024 At the very outset, learned counsel for the petitioners submits that the petitioner No. 1 (Bhikho Yadav) has been arrested and his application has become infructuous.

2. It is accordingly dismissed as withdrawn.

3. Now the application is restricted to the petitioners No. 2 and 3 only.

4. Heard learned counsel for the petitioners and learned APP appearing on behalf of the State.

5. The petitioners apprehend their arrest in connection with Sahebpur Kamal P.S. Case No. 110/2024 for the offences punishable under Sections 147/341/323/307/325/379 and 504 of

Patna High Court CR. MISC. No.77171 of 2024(2) dt.11-12-2024 2/2 the Indian Penal Code.

6. Learned counsel for the petitioners submits that petitioner No. 2 and 3 are not alleged to have assaulted the victim but there is an ornamental allegation of snatching the chain and taking out the money.

7. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

8. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners No. 2 and 3 be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM IV, Begusari in connection with Sahebpur Kamal P.S. Case No. 110/2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

9. The prayer of the petitioner No. 1 is rejected and the application of the petitioners No. 2 and 3 is allowed. (Sandeep Kumar, J) Saif/- U T
