The petitioner has prayed for bail in connection with Pirpanti (Bakharpur) P.S. Case No. 176 of 2022 registered for the offence punishable under sections 364/34 of the Indian Penal Code.

As per allegation in the FIR, the brother of the informant is said to have been abducted by the petitioner and other accused persons with intention to kill him. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is not named in the FIR and on the basis of suspicion he has been arrested by the police. Save and except his self confessional statement, nothing has come against the petitioner

Patna High Court CR. MISC. No.74109 of 2022(5) dt.20-06-2023 2/2 to show his involvement in the present case. Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 24.3.2023 passed in Cr. Misc. No. 68436 of 2022. He has got no criminal and he is languishing in judicial custody since 12.6.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XIV, Bhagalpur in connection with Pirpanti (Bhakarpur) P.S.
