JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Forbesganj P.S. Case No. 134 of 2018 for the offence under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that although the case was registered against unknown, but the petitioner has been made accused in the instant case only on account of the fact that he has bad antecedent record, as he has been made accused in past in similar type of cases. He submits that the petitioner is in custody since 06.07.2018, but he has not been put on T.I.P., which is essential for identification of the accused, as the informant has claimed that he can identify the miscreants.

Considering the aforesaid, the petitioner, named

Patna High Court Cr.Misc. No.77092 of 2018(2) dt.10-01-2019 2/2 above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ashish Ranjan, Judicial Magistrate, 1st Class, Araria in connection with Forbesganj P.S. Case No. 134 of 2018.
