This application has been filed for modification of order dated 13.09.2019 passed in Criminal Misc. No.57639 of 2019.

Learned counsel for the petitioner submits that vide order dated 13.09.2019 passed in Criminal Misc. No.57639 of 2019, the petitioner was directed to be released on bail, in the event of arrest and surrender before the court below within a period of four weeks, in connection with Mokama P.S. Case No. 132 of 2019 (Spacial Case No. 5705 of 2019), pending in the court of Special Judge Excise, Patna, but in the second and last paragraph of aforesaid order dated 13.09.2019, "Special Case

Patna High Court CR. MISC. No.70426 of 2019(2) dt.16-01-2020 2/2 No. 6082 of 2019" has wrongly been typed in place of "Spacial Case No. 5705 of 2019" and due to that reason, petitioner could not surrender before the court below within the stipulated time. In view of the above submission, in the second and last paragraph of order dated 13.09.2019, in place of "Special Case no. 6082 of 2019" it be read as "Spacial Case No. 5705 of 2019" and the period of surrender of petitioner is extended for four weeks from today. The order dated 13.09.2019 passed in Criminal Misc. No.57639 of 2019 is modified to the said extent. Accordingly, this application is disposed of. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
