2. The petitioner seeks bail in a case registered for offence under Sections 302, 120B , 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. It is alleged that on account of money dispute between the parties, this petitioner and other co-accused persons committed murder of brother of informant

4. Petitioner is not named in the F.I.R. Name of the petitioner surfaced in this case on the basis of confessional Statement of co-accused Tarzan. Save & except confession of co-accused, there is no other tangible material against this petitioner to show his complicity in the alleged occurrence.

Patna High Court CR. MISC. No.73805 of 2025(2) dt.04-11-2025 2/2 Similarly situated co-accused persons have been granted bail by a coordinate Bench of this Court, vide orders annexed at Annexures P/3 and P/4 to the bail petition. Petitioner has got clean antecedent and is in custody since 07.07.2025.

5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bhagalpur in connection with Habibpur P.S. Case No. 75 of 2023.
