Petitioner seeks bail in connection with Sakra P.S. Case No. 335 of 2019 registered for the offence punishable under sections 399, 402 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act and Section 30(a) of the Bihar Excise Act.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern with the seized article. Similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court vide
Patna High Court CR. MISC. No.66233 of 2019(2) dt.13-11-2019 2/2 orders dated 24.09.2019 and 25.10.2019 passed in Cr. Misc. Nos. 59967 of 2019 and 68347 of 2019 respectively. Learned counsel has produced the web copy of the aforesaid orders. Let it be kept on record. Petitioner has no criminal antecedent. Petitioner is in custody since 07.07.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Muzaffarpur in connection with Sakra P.S. Case No. 335 of 2019.
