JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 This is an application for grant of anticipatory bail in connection with Motihari Muffasil P. S. Case No. 258 of 2019, disclosing offences under Sections 341, 323, 307, 504, 34 of the Indian Penal Code.

As per F.I.R. there was a dispute with respect to transaction of money that petitioner is said to have taken some loan from the son of the informant and when son of the informant demanded the money, they have taken bond and torn the same and they dashed the vehicle on the son of the informant, causing serious injury.

Submission of the learned counsel for the petitioner is that the statement of father of the informant was recorded during

Patna High Court CR. MISC. No.69462 of 2019(3) dt.19-11-2019 2/2 the investigation, in which, he has not stated the allegation of transaction of money and stated that while the accused persons were fleeing from there, the son of the informant came in front of the vehicle, caused injury to him.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M.-East Champaran, Motihari, in connection with Motihari Muffasil P. S. Case No. 258 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
