JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Aurangabad(Muffasil) P.S. Case No. 176 of 2018 dated 07.10.2018 instituted for the offences under Sections 452, 323, 325, 307, 354, 354(A), 34 of the Indian Penal Code.
The petitioner is alleged to have entered into the room of the minor daughter of the informant through the roof with the intention of misbehaving with her. When the informant reached the room, the petitioner is alleged to have jumped from the house and managed his escape. The learned counsel for the petitioner has submitted that an absolutely false case has been lodged by the informant and the purpose of filing the same is the enmity which was generated during the election time. No.79844 of 2018(2) dt.16-01-2019 2/2 from this, learned counsel for the petitioner has stated before this Court that the mother of the petitioner had earlier filed a case against the informant and others but because of the influence of the informant with the local Police, her case was registered later.
Considering the nature of allegation levelled in the F.I.R, the background facts and the petitioner being a person of clean antecedents, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Aurangabad in connection with Aurangabad(Muffasil) P.S. Case No. 176 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
