The petitioner seeks bail in anticipation of his arrest in connection with Jokihat P. S. Case No. 353 of 2017 dated 03.11.2017 instituted for the offences under Sections 447, 341, 323, 324, 325, 307, 379, 504 and 506/34 of the Indian Penal Code.

After some arguments, Mr. Anamul Haque, learned counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the court below and seek bail.

Should such an application be filed, the court below

Patna High Court Cr.Misc. No.79776 of 2018(2) dt.16-01-2019 2/2 shall take into account that the petitioner is an elderly person and that there is a counter version of the occurrence as well in which many persons from the side of the petitioner also stand injured and that the occurrence took place because of fixing of tube-well, and shall pass orders in accordance with law without being prejudiced with the fact that the present petition has not been entertained by this Court.
