The petitioners are apprehending their arrest in connection with Nawada G.O. (F) Case no.298 of 2016/331 of 2016 , registered for offences punishable under Sections 2,9, 39, 44, 49 of the Wilf Life Protection Act, 1872. Allegation against the petitioners is about recovery of skin of the wild animal from one co-accused and the petitioners are the assistants of the co-accused.
Submission of the learned counsel for the petitioners is that they have been falsely implicated in this case on the basis of suspicion and they have no criminal antecedent. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.78799 of 2018(3) dt.11-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM II, Nawada in connection with Nawada G.O. (F) Case No.298 of 2016/331 of 2016, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
