The petitioner seeks bail in a case registered under Sections 379, 427/34 of the Indian Penal Code. Allegation is that unknown thieves stolen away Rs.11,19,000/- from the A.T.M.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.09.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. There is no recovery of any incriminating article from the petitioner. The petitioner has not been put on T.I.P. Co-accused has been granted bail vide

Patna High Court CR. MISC. No.66075 of 2019(2) dt.21-10-2019 2/2 Annexure 2 to the present application.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manoj Kumar, J.M. 1st class, Barh, Patna in connection with N.T.P.C. P.S. case No.50 of 2018.
