Mr. Bhanu Pratap Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 17-04-2025 Heard Mr. Upendra Kumar Chaubey, learned counsel for the petitioner and Mr. Bhanu Pratap Singh, learned APP for the State.

2. The petitioner is apprehending her arrest in connection with Fakuli P.S. Case No. 23 of 2024, F.I.R. dated 27.05.2024 for the offences punishable under Sections 341, 323,324,325, 307 & 34 of the Indian Penal Code.

3. According to prosecution case, when the informant was ploughing his field, petitioner alongwith others came and assaulted him by brick on his head.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and she has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the

5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that it transpires from the FIR itself that there is direct and specific allegation of assault against the petitioner due to which the informant received injury and the injury report of the informant suggest that injury is grievous in nature.

6. Considering the allegation and the fact that there is direct and specific allegation of assault against the petitioner and the injury sustained by the informant is grievous in nature, I am not inclined to grant the privilege of anticipatory bail to the petitioners in connection with Fakuli P.S. Case No. 23 of 2024 pending in the court of 1st Class Judicial Magistrate, 8th West, Muzaffarpur.

7. Prayer is refused.
