Petitioner seeks bail in Bakhtiyarpur P.S. Case No.345/18 registered for the offences punishable under Sections 337, 338, 307, 353, 429, 34 of the Indian Penal Code and Sections 25(1-b)a/26/27/35 of the Arms Act.
Allegation against the petitioner is recovery of one country made loaded pistol, two live cartridges and three empty cartridges from his possession.
It appears that petitioner is accused in six more cases. Petitioner is in custody since 05.07.2018.
Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.
However, after completion of 9 months in judicial
Patna High Court Cr.Misc. No.78138 of 2018(2) dt.09-01-2019 2/2 custody, the petitioner named above be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Barh at Patna in connection with Bakhtiyarpur P.S. Case No.345/18 with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (S. Kumar, J) Sanjay/- U T
