JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-10-2019 This application, for grant of anticipatory bail, arises out of Mainatar P.S. Case No. 60/2019, disclosing offences under Sections 147, 148, 149, 323, 504, 506, 427, 353, 499, 447 of the Indian Penal Code.

Allegation against the petitioners others is of damaging the public property after locking the gate of power house and also abused and assault the staffs of Electric Department.

Submission of learned counsel for the petitioners is that only general and omnibus allegation has been attributed to

Patna High Court CR. MISC. No.66732 of 2019(2) dt.23-10-2019 2/2 the petitioners and the real fact is that they were protesting the regular power cut and due to which, they have falsely been roped in the present case.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bettiah, West Champaran, in connection with Mainatar P.S. Case No. 60/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
