The petitioner seeks bail in Fulkaha P.S. Case No. 115/2018, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that on getting secret information, police party reached at the place of occurrence and saw two persons coming on two motorcycles with Jute bag. Seeing the police party, both persons managed to run away. The police seized 108 litres of Nepali liquor from aforesaid two motorcycles. The villagers disclosed the name of this petitioner to the police.
Learned counsel for the petitioner has submitted that petitioner has been made accused in this case merely on
Patna High Court Cr.Misc. No.77547 of 2018(2) dt.15-01-2019 2/2 suspicion. There is no recovery of any incriminating article from conscious possession of this petitioner.
Petitioner has clean antecedent. He is in custody since 10.11.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-cum-Spl. Judge, Araria, in connection with Fulkaha P.S. Case No. 115/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
