2. The petitioner seeks bail in connection with Belaganj P.S. Case No. 370 of 2025 instituted for the offences punishable under Sections 304 (2) of the BNS, 2023.
3. As per the prosecution case, two unknown accused persons on a motorcycle snatched the purse and Mangal Sutra of gold from the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that in course of investigation the police identified one Akshay Kumar with the help of CCTV footage and was apprehended and he disclosed the name of other co-accused persons namely Prince Kumar, Raushan @ Prakash Kumar @ Bagga, Sintu @ Boss and Anurag

He further describe the role of accomplish i.e., Prince @ Bagga, who was driving the motorcycle and the role of the petitioner is that he was doing 'Reki'. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 29.06.2025.
5. Learned APP for the State opposes the prayer for bail.
6. From perusal of the FIR and impugned order of the learned District and Additional Sessions Judge-III, Gaya dated 03.09.2025, it appears that petitioner is not named in the FIR. From perusal of the records, it appears that on the basis of written report of the informant Rupa Singh, FIR has been registered under Sections 304 (2) of the BNS, 2023 against two unknown persons and the allegation is of snatching purse and gold Mangal Sutra from the informant. During the course of investigation the name of the petitioner has been surfaced from CCTV footage but no recovery from the conscious possession of the petitioner, so considering all these aspects of the case and submissions of learned counsel for the petitioner, I am inclined to grant bail to the petitioner.
7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on
Patna High Court CR. MISC. No.74263 of 2025(2) dt.19-11-2025 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Belaganj P.S. Case No. 370 of 2025, subject to the condition the the petitioner shall remain physically present on each and every date fixed by the Trial Court till conclusion of the trial.
