Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 325, 452, 379,

Patna High Court CR. MISC. No.78105 of 2023(2) dt.08-12-2023 2/3 354, 307 of the IPC.

Allegedly, the petitioners along with other co-accused persons are alleged to have indiscriminately assaulted the informant's son and other family members by means of various weapons.

It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case due to ulterior motive. Parties are next door neighbors and there is a land dispute between them. Petitioner nos.1, 2 and 5 have two criminal antecedent each and petitioner no.7 has one criminal antecedent and petitioner nos.3, 4 and 6 have no criminal antecedent. Several similarly situated co-accused have been granted anticipatory bail by this Court vide order dated 05.12.2023 passed in Cr. Misc. No.76345 of 2023. 5.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case, since similarly situated co-accused have been granted bail, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties
