2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109(1), 303(2), 352 and 3(5) of the B.N.S.
3. The case of the prosecution is that the petitioner and one other person stopped the informant and assaulted him with fist near his ear and snatched golden chain and Rs.5,000/-. It is further alleged that a knife blow was also given to the informant in left side of his rib.
4. Learned counsel for the petitioner submits that from perusal of the FIR it is clear that there were two persons and it is not clear from the FIR as to who has given the knife
Patna High Court CR. MISC. No.80176 of 2024(3) dt.25-02-2025 2/2 blow and who has snatched the cash. From perusal of the injury report it is clear that the informant has received superficial injury. The wound was sharp cut but nature of injury is simple. The petitioner is in custody since 03.08.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail of the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Basantpur P.S. Case no. 445 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Siwan.
7. Accordingly, the present bail application stand allowed.
