2. In this case, the petitioner is apprehending his arrest in connection with Ara Muffasil P.S. Case No. 189 of 2022, registered on 15.06.2022 for the offences under Sections 341, 323, 324, 379, 504, 506 and 34 of the Indian Penal Code.
3. Prosecution case is that, petitioner and other coaccused persons started assaulting the informant and his son causing a number of injuries to them.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely in this case. There is a case and counter-case and son of the petitioner has filed Muffasil P.S. Case No. 190/2022 for the same occurrence which has been registered for the offences under Sections 341, 323,
Patna High Court CR. MISC. No.74683 of 2022(2) dt.01-05-2023 2/3 324, 307, 379, 504, 506/34 of Indian Penal Code against the informant and his family members. Learned counsel further submits that injuries on the injured persons have been found to be simple in nature and a number of co-accused persons have been enlarged on anticipatory bail by the learned court below.
5. Learned APP opposes the prayer for anticipatory bail.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the case and counter-case between the parties and also the nature of injury which is stated to be simple, let the petitioner above named, in the event of his arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Bhojpur at Ara/court concerned in connection with Ara Muffasil P.S. Case No. 189 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
