The petitioner seeks regular bail in connection with Parbatta P.S.Case No.113 of 2019 instituted for the offences punishable under Sections 380 and 411 of the Indian Penal Code.

The FIR relates to an occurrence of in a dwelling house. Two miscreants were apprehended along with stolen articles and they disclosed the name of the petitioner as coculprit. Petitioner has stated on oath that he has got no criminal antecedent and he is in custody since 20.08.2019. Investigation of the case is already complete. Petitioner was never put on test identification parade nor anything incriminating article has been recovered.

No.65344 of 2019(4) dt.17-12-2019 2/2 Considering the aforesaid facts, let the above named petitioner be released on regular bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Khagaria in connection with Parbatta P.S.Case No.113 of 2019/G.R.No.961 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
