JUSTICE BIRENDRA KUMAR ORAL ORDER 22-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Chausa P.S. Case No. 225 of 2018 registered for the offence punishable under Sections 147, 341, 323, 307, 120-B, 504 and 506 of the Indian Penal Code and 27 of Arms Act.
Allegation is that the petitioner was a member of the unlawful assembly. There is allegation of commission of assault against the informant.
Considering the aforesaid submission and the fact that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of
Patna High Court Cr.Misc. No.79397 of 2018(2) dt.22-01-2019 2/2 receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrte, Udakishunganj, Madhepura in connection with Chausa P.S. Case No. 225 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
