In this case, the petitioner is seeking regular bail in connection with Sessions Trial No.09 of 2018, arising out of Lakhisarai P.S. Case No. 592 of 2015, registered for the offence under Sections 147, 148, 307 and 302 of the Indian Penal Code and under Section 27 of the Arms Act.

This is the third attempt on behalf of the petitioner for grant of regular bail. On earlier two occasions, this Court had refused to grant bail to this petitioner. In such view of the matter, this Court is not inclined to reconsider the prayer for bail of the petitioner.

No.69154 of 2019(3) dt.29-01-2020 2/2 However, from the status report of the Court below, it appears that out of eleven witnesses, three non-official witnesses have been examined. Hence, this Court directs the Senior Superintendent of Police, Lakhisaria, to ensure the production of rest non-official as well as official witnesses before the Court below and the Court below will conclude the trial within a period of nine months from the date of receipt / production of a copy of this order.

It is made clear that if the Senior Superintendent of Police, would fail to take steps for production of rest witnesses, this Court will treat the same to be the contempt of Court and straightway may initiate a contempt proceeding against the Senior Superintendent of Police, Lakhisaria, for violating the order of this Court.

With the aforesaid observations and directions, this bail application stands disposed of.
