JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 The petitioner apprehends his arrest in connection with Doriganj P.S.Case No. 92 of 2017 registered under Sections 272 and 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation as per FIR is of recovery of 35 litres of wine from a motorcycle and accused persons succeeded in fleeing away and petitioner is not named in the FIR.

Submission of learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner and he is no criminal antecedent.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail

Patna High Court Cr.Misc. No.78071 of 2018(2) dt.04-01-2019 2/2 upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Addl. Sessions Judge, Saran at Chapra in connection with Doriganj P.S. Case No. 92 of 2017; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
