JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Guraru P.S. Case No. 102 of 2019, registered for the offences punishable under Sections 30 (a) (b) (c) of Bihar Prohibition and Excise Act, 2016.
As per F.I.R. there is recovery of 25 liters country made liquor from the hut of one Nawal Kishore Singh, petitioner happens to be son of the Nawal Kishore Singh. Submission of the learned counsel for the petitioner is that he is residing outside having no criminal antecedent. Only he has son of Nawal Kishore Singh he has been made accused in this case.
Learned A.P.P has opposed the bail prayer of the petitioner on the ground that petitioner is named in the F.I.R. Having heard both sides, in view of the allegation as
Patna High Court CR. MISC. No.68929 of 2019(2) dt.18-11-2019 2/2 discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned Court below within three weeks from the receipt of the certified copy of the order and make prayer for regular bail which shall be considered on the basis of material available on record without being prejudiced by this order and possible to be disposed of on the same day.
