JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-11-2019 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest for the offences alleged under Sections 25(1-B)a, 26 and 35 of the Arms Act registered in connection with Islampur P.S. Case No. 391 of 2019. Learned counsel for the petitioner submits that no incriminating articles have been recovered from conscious possession of the petitioner but the country made Katta and cartridges have been recovered from the possession of co-accused Pankaj Prasad, who was arrested at the spot. Learned counsel further submits that the petitioner's name transpired on the confessional statement of the said Pankaj Prasad. He further submits that the petitioner has no concern with the said Pankaj Prasad. The petitioner has no criminal antecedents.

Case No. 391 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
