Mr. Bharat Bhushan ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State along with the learned counsel for the N.B.P.D.C.L.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.

The informant alleges that the petitioner defalcated an amount of Rs. 9,000/- and Rs. 15,000/- collected from consumer of the electricity company thus causing revenue loss to the government.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that the petitioner was hired as one of the staff

Patna High Court CR. MISC. No.73611 of 2022(3) dt.19-06-2023 2/2 by the franchise company for collecting the money due from the consumer of the electricity, it is next submitted that the petitioner after collecting the money deposited the same with the department, as would be evident from Annexure 2 to the anticipatory bail application.

Learned counsel for the North Bihar Power Distribution Company Ltd. (NBPDCL) and learned A.P.P. for the State oppose the bail application but are not in a position to dispute Annexure 2 to the anticipatory bail application. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ganga Bridge P.S. Case No. 196 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
