2. Petitioner seeks regular bail in connection with Dumariyaghat P. S. Case No. 15 of 2025 in a case registered for the offences punishable under Section 103(1) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, six named persons and five unknown persons are said to have assaulted the deceased. The deceased succumbed to injury during the course of treatment on the same day.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that as per the FIR, six

No.75234 of 2025(2) dt.13-11-2025 2/2 named and five unknown persons assaulted the deceased but in the post-mortem report, doctor has found only one injury on the body of the deceased, hence, the post-mortem report does not corroborate with the allegation as mentioned in the FIR. Similarly situated co-accused person has already been granted bail by the Co-ordinate Bench of this Court vide order dated 08.10.2025 passed in Cr. Misc. No. 47686 of 2025. The petitioner has one criminal antecedent and he is in custody since 18.02.2025. Charge-sheet has already been submitted.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge- 10, East Champaran/concerned Court below in connection with Dumariyaghat P. S. Case No. 15 of 2025.
