Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307, 354(B) and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, on account of land dispute and family feud these petitioners are alleged to have assaulted the informant and his family members and caused injuries to them.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in

Patna High Court CR. MISC. No.1298 of 2023(2) dt.27-03-2023 2/2 the case on account of land dispute. Petitioner No.1 is full brother of informant and petitioners No.2 and 3 are his nephews.. Petitioners have got clean antecedent. The doctor found the injuries sustained by the injured to be simple in nature.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Bikramganj PS case No. 328 / 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
