The petitioner seeks regular bail in Kaluahi P.S. Case No. 46/2016, registered for the offence punishable under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is not named in the F.I.R. There is no recovery from possession of the petitioner. No Test Identification Parade (T.I.P.) has been held. Name of the petitioner has come in the confessional statement of co-accused. Petitioner is in custody since 03.08.2017.
Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.734 of 2019(2) dt.18-01-2019 2/2 bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Madhubani in connection with Kaluahi P.S. Case No. 46/2016, subject to the condition that both the bailors will be close relative of the petitioner.
