JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 Petitioners apprehend their arrest in connection with Special Case No. 119 of 2018, arising out of Alamganj P.S. Case No. 593 of 2018 registered for the offences punishable under Sections 20 and 22 of N.D.P.S. Act.

Allegation is of recovery of ganja, smack and cash from the room of one Suresh Kumar Singh, husband of petitioner No.1 and petitioner No.2 is son of petitioner No.1. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and recovery has been made from the house of Suresh Kumar Singh and not from the conscious possession of the petitioners. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.78723 of 2018(2) dt.10-01-2019 2/2 circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, Patna, in connection with Special Case No. 119 of 2018, arising out of Alamganj P.S. Case No. 593 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
