====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Pauthu P.S. Case No. 62 of 2018 instituted for the offence under Sections 354, 354(A), 354(B), 354(D), 376, 511, 323, 504 and 506 of the Indian Penal Code.

In the written report it is alleged that petitioner and informant were distant relative of the informant. They both used to do combined study. The petitioner proposed the informant to marry with him. She replied that she will think after completion of her education. Thereafter, petitioner started living in her village. Both developed intimacy. It is further alleged that petitioner attempted to outrage modesty of the informant on several times as mentioned in the written report.

Counsel for the petitioner submits that both parties are distant relatives as would appear from the written report itself. Petitioner and informant were known to each other since 2015. The instant case has been filed on 25.8.2018. The informant is major. She did not raise any complain prior to filling of the instant First Information Report. There is general and omnibus allegation against the petitioner. Petitioner is in custody since 26.8.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-2nd, Aurangabad, in connection with Pauthu P.S. Case No. 62 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
