JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2019 Petitioner apprehends his arrest in connection with Kumarkhand P.S.Case No. 01 of 2016 registered for the offences punishable under Sections 341, 323, 504, 506, 498A, 34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

Petitioner happens to be Debar of the informant and the case is under Section 498A IPC.

Submission of learned counsel for the petitioner is that earlier petitioner was granted anticipatory bail vide order dated 1.2.2016 passed by learned Sessions Judge in A.B.P. No. 62 of 2016 but he could not surrender and thereafter his prayer for anticipatory bail was rejected vide order dated 4.10.2018 in A.B.P. No. 853 of 2018.

Having heard both sides and in view of conduct of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered by learned court below considering the fact that petitioner has earlier been granted anticipatory bail and to be disposed of on the same day, if possible.

With the above observation, this application is dismissed.
