2. The petitioner seeks pre-arrest bail in connection with Nawanagar (Sonbarsha O.P.) P.S. Case No. 89 of 2024 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. The allegation is of recovery of 10 litres of country made liquor from outside the house of the petitioner.

4. Learned counsel appearing on behalf of the petitioner submitted that earlier the petitioner was granted anticipatory bail by this Court vide order dated 26.06.2024 passed in Cr. Misc. No.37819 of 2024, but his bail bond was not

Patna High Court CR. MISC. No.78217 of 2024(2) dt.20-12-2024 2/2 accepted due to incorrect criminal antecedent mentioned in paragraph no.3 thereof. Learned counsel further submitted that petitioner has now given the correct information with respect to their criminal antecedent in paragraph no.3 in the present bail application.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

6. In the facts and circumstances of the case, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court No.2, Buxar in connection with Buxar Nawanagar (Sonversa ) P.S. Case No. 89 of 2024, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) Sanjay/- U T
