JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Town P.S. Case No. 439 of 2018 for the offences under Sections 423,467,468, 471,427, 473, 120B, 34 of the Indian Penal code, 1860 (IPC).

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits petitioner has been made accused in the instant case because he is the after of the main accused Lal Saheb @ Rarun, who has used forged certificate to show that he is juvenile and entitled to the benefit of juvenality. He further submits that the petitioner is in custody since 11.07.2018.

Considering the facts and circumstances discussed
