JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

In huge quantity, Indian made foreign liquor was recovered while the said liquor was being carried on a Motorcycle by two persons, who managed to escape from the place of occurrence when police tried to intercept the Motorcycle. However, in course of investigation, it came to light that the petitioner was owner of the aforesaid Motorcycle. Submission on behalf of the petitioner is that, as a matter of fact, at the time of so-called recovery of liquor,

No.66480 of 2019(2) dt.25-10-2019 2/2 petitioner was not carrying the documents of the said Motorcycle and having seen the raiding party, he fled away from there leaving behind his Motorcycle due to fear but, subsequently, police implicated the petitioner in the case of excise. Petitioner does not have any criminal antecedent and languishing in jail custody since 16.09.2019. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judgecum-Special Judge, Excise, Kaimur (Bhabua) in connection with Excise Case No. 223 of 2019 arising out of Kudra P. S. Case No. 106 of 2019.
