2. The petitioner seeks bail in connection with Chakia P.S. Case No. 238 of 2023 registered for the offence punishable under Sections 393 and 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Unknown criminals while committing a loot, shot at the victim, thereby the victim died. During investigation, no legal evidence has come to connect the petitioner with the crime. The petitioner is in jail since 22.07.2024.

4. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

5. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.80787 of 2024(3) dt.29-01-2025 2/2 of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Chakia P.S. Case No. 238 of 2023.

6. The petitioner will also mark attendance in Bhopatpur Police Station, East Champaran on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
