The petitioner apprehends his arrest in connection with Jaynagar P.S. Case No.309 of 2022, registered for the offence punishable under Section 392 of the Indian Penal Code Later on, Section 411 of the Indian Penal Code was added. The accusation against the petitioner is of snatching Rs.12,000/- cash, mobile phone and motorcycle of the informant on the point of pistol.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got one criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the petitioner is not named in the FIR. Co-accused, Deepak Kumar in his

Patna High Court CR. MISC. No.74464 of 2022(2) dt.04-02-2023 2/2 confessional statement has disclosed the name of the petitioner. It is also submitted that the looted articles were recovered from possession of the co-accused.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforesaid and considering the nature of offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected. (Anjani Kumar Sharan, J) S.KUMAR/- U T
