1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Kotwa P.S. Case No. 15 of 2018 dated 25.01.2018 registered under Sections 363, 366 of the I.P.C.

3. As per the first information report the married daughter of the informant became trace less on 18/19.01.2018 along with ornaments, clothes etc. Upon search, the informant came to know that the petitioner has kidnapped the daughter of the informant.

4. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and the daughter of the informant being married and major eloped with the petitioner on free will. The statement of the victim girl was

Patna High Court CR. MISC. No.76717 of 2024(2) dt.18-11-2024 2/2 recorded under Section 164 Cr.P.C. on 15.07.2024 in which she has stated that she has solemnized marriage with the petitioner and from the wedlock with the petitioner two children were born.

5. Regard being had to the submission made by the parties, taking into consideration the statement of the victim girl recorded under Section 164 Cr.P.C. on 15.07.2024, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-10th, East Champaran, Motihari in connection with Kotwa P.S. Case No. 15 of 2018 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
