2. The petitioner apprehends his arrest in connection with Buxar (M) P.S. Case No.259 of 2025 registered for the offences punishable under Sections 126(2), 115, 117, 351, 352, 109, 303(2), 74 and 3(5) of the BNS.
3. Based upon the written report, the prosecution alleges that, on the fateful day, while the informant was returning to her house along with her husband, in the meanwhile, all the miscreants surrounded them. It is specifically alleged that on the exhortation made by co-accused Bashishth Singh, this petitioner assaulted the brother-in-law of the informant, Jai Shankar Rai who came to her rescue, over his head by means of iron rod, due to which he sustained serious
Patna High Court CR. MISC. No.74018 of 2025(2) dt.24-11-2025 2/3 injury. There is further allegation against other co-accused persons of causing assault and misbehaving with the informant.

Learned Advocate for the petitioner submitted that admittedly the parties are bickering over a land dispute as is manifest from the pendency of Title Suit No. 272 of 2025, before the learned Civil Judge (Senior Division) 1st, Buxar. In fact, on the fateful day, on account of some instigation made by the person of both the sides, they entered into a free fight, leading to institution of case and counter case being Buxar P.S. Case No. 260 of 2025. In the said occurrence, the petitioner was brutally assaulted by the informant and her family members and he was remained under treatment for a pretty long time. The petitioner bears fair antecedent and he undertakes that he will fully cooperate in the proceeding of the Court.
5. Learned Advocate for the State vehemently opposed the bail application and submitted that the petitioner has specifically assaulted the informant by means of iron rod.
6. Having considered the submissions advanced by the learned Advocate for the respective parties and considering the factum of case and counter case, coupled with the simple injury sustained to the injured Jay Shankar Rai, besides the genesis of the occurrence and the fair antecedent of the

No.74018 of 2025(2) dt.24-11-2025 3/3 petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate in connection with Buxar (M) P.S. Case No.259 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioner.
