2. The petitioner has preferred this application for grant of regular bail in connection with Tariyani Chowk P.S. Case No. 162/2025 dated 05.08.2025 registered for the offences punishable u/ss 137(2) and 96 of the B.N.S.
3. As per the prosecution case, the petitioner is alleged to have kidnapped the minor daughter of the informant for the purpose of marriage or for selling her.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There was love affair between the victim and the petitioner. The victim in her statement recorded u/s 183 of the
Patna High Court CR. MISC. No.72010 of 2025(2) dt.01-11-2025 2/2 B.N.S.S. has stated that she herself left her house on account of assault by her parents and thereafter she called the petitioner and went with him to Muzaffarpur and then to Delhi. The victim in her statement recorded u/s 183 of the B.N.S.S. has not stated that she was forced or seduced to have intercourse with another person. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 06.08.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the victim is a minor girl.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sheohar in connection with Tariyani P.S. Case No. 162/2025.
7. The application stands allowed.
