Earlier prayer for bail of the petitioner was dismissed twice vide order dated 09.11.2017 passed in Cr. Miscellaneous No. 49693 of 2017 and vide order dated 28.02.2018 passed in Cr. Misc. No. 10053 of 2018, in connection with Maniyari P.S. Case No. 154 of 2017 and allegation against the petitioner is of demand of extortion from the informant.

Submission of learned counsel for the petitioner is that he has been in judicial custody since 01.08.2017 and in spite of direction of this court to conclude the trial within a period of eight months vide order dated 08.02.2018, the same has not been concluded.

Patna High Court Cr.Misc. No.76479 of 2018(3) dt.07-02-2019 2/2 called for from the concerned trial court, which has since been received, from which, it appears that uptil now only one witness has been examined in spite of all the processes issued against the witnesses. However, the trial court has assured that he will dispose of the trial in the month of February, 2019. In such view of the matter, I am not inclined to enlarge the petitioner on bail. The trial court is directed to expedite the trial.

At the same time, Superintendent of Police, Muzaffarpur, is directed to ensure the production of witnesses in the trial court so that the trail be concluded expeditiously. (Vinod Kumar Sinha, J) sunilkumar/- U T
