JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2019 This application, for grant of anticipatory bail, arises out of Begusarai (Muffasil) P.S. Case No. 28 of 2018, disclosing offences under Sections 467, 468, 409 and 420 of the Indian Penal code.

Allegation against the petitioner is of illegally getting himself appointed as Buniyadi Health Worker.

Submission of learned counsel for the petitioner is that without any enquiry, the present case has been lodged against the petitioner. It has also been submitted that similarly situated person has already been granted the privilege of anticipatory bail by this Court vide order dated 23.08.2018 passed in Cr. Miscellaneous No. 48177 of 2018 and the petitioner's case is exactly same and similar.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai (Muffasil) P.S. Case No. 28 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
