Learned counsel appearing on behalf of the petitioner submits that petitioner has been granted Anticipatory Bail on 06.08.2019 passed in Criminal Miscellaneous No. 73904 of 2018 with a direction to surrender before the court below within a period of eight weeks pending in the Court of learned Sri Devesh Kumar, Sub Divisional Judicial Magistrate, Hilsa (Nalanda) in connection with Compliant Case No. 162 (C) of 2018 / Trial No. 24871 of 2018, subject to the conditions

Patna High Court CR. MISC. No.70494 of 2019(2) dt.26-02-2020 2/2 laid down under Section 438(2) Cr.P.C., with further condition that the petitioner shall show the receipt of showing the payment of Rs. 5,00,000/- to the Opposite Party No.2., but due to some unavoidable circumstances, petitioner could not surrender before the court below within the stipulated time. In such view of the matter, let the time to surrender of the petitioner as ordered on 06.08.2019 passed in Criminal Miscellaneous No. 73904 of 2018 be further extended by four weeks from today.

Accordingly, the modification application is allowed and the order dated 06.08.2019 passed in Criminal Miscellaneous No. 73904 of 2018 is modified to the above extent.
