In this case, the petitioner is seeking anticipatory bail in connection with Mahishi P.S. Case No. 150 of 2010, registered for the offence punishable under Sections 409, 420 and 406/34 of the Indian Penal Code.

This matter relates to illegal withdrawal of the Government money. Altogether 78 persons have been made accused, the petitioner is an accused among them. As per the record, it appears that an amount of Rs.87,500/- was given to the present petitioner for the construction of the hospital for animals and the same was invested in the construction of the hospital and the account has been re-conciliated as well as No Dues Certificate has been

Patna High Court Cr.Misc. No.79006 of 2018(2) dt.09-01-2019 2/2 issued to him, which is apparent from Annexure-2. Looking to the entire facts and circumstances of the case, let the petitioner, namely, Sunil Kumar Singh, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Saharsa, in connection with Mahishi P.S. Case no.150 of 2010, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
